Résumé

Le TA a confirmé une suspension de deux mois et une amende de frs. 3'000.prononcées par la commission du Barreau à l'encontre d'un avocat accusé de manquements répétés et de légèreté dans ses écritures adressées au TF (examen des griefs "nullum crimen sine lege", "ne bis in idem" et proportionnalité de la sanction). Le fait de ne pas mentionner l'existence d'un accord transactionnel est qualifié de légèreté inadmissible et incompatible avec le respect des devoirs de l'avocat. Au regard du principe de la légalité, les termes "tout manquement aux devoirs professionnels" de l'art. 49 LPAV décrivent de manière suffisamment précise les comportements qui peuvent être sanctionnés par la Commission du barreau. Ne viole pas le pricipe "ne bis in idem" une sanction disciplinaire prononcée à la suite d'une amende disciplinaire infligée par le Tribunal fédéral sur la base de l'art. 30 al.2 OJ.
