Omnilex summary

The court upheld the annual contribution imposed on vineyard owners or lessees under LVIT art. 18. It held that the levy is a preferential charge with a sufficient statutory basis, is not disproportionate, and does not breach federal supremacy because federal wine legislation permits cantons to adopt measures protecting vine cultivation. The court also accepted that, after the disappearance of the Federation of Winegrowers, the Department could seek the opinion of the AOVG, which may assume the federation's former role. The use of the viticulture fund by the AOVG was found compatible with the LVIT, although spending on political campaigns was criticized.

Omnilex headnote

LVIT art. 18; legality, proportionality and federal supremacy of a cantonal viticulture contribution; consultation under LVIT art. 19 after disappearance of the designated professional federation. The annual contribution imposed on vineyard owners or lessees constitutes a preferential charge resting on a sufficient legal basis and is not excessive where it serves the protection of vine cultivation. It is not pre-empted by federal law when the federal wine statute expressly leaves room for cantonal protective measures. If the body whose prior opinion is required by law no longer exists, the competent department may obtain the opinion of a functionally equivalent association able to assume its role. The use of the viticulture fund remains statutorily compliant notwithstanding criticism of politically oriented expenditures.

LVIT.18

Key legal question

Whether the annual contribution under LVIT art. 18 has a sufficient legal basis and is proportionate, and whether it violates federal supremacy.

Extracted holding

The contribution is a preferential charge with a sufficient legal basis; it is not disproportionate and does not violate federal supremacy because federal viticulture law allows cantons to adopt measures protecting vine cultivation.

Extracted reasoning

The cantonal levy pursues viticulture protection, which is compatible with the federal wine statute's reservation of cantonal protective measures. The charge therefore withstands review under legality, proportionality, and federal pre-emption.

Key legal question

Whether the Department could seek the AOVG's opinion after the Federation of Winegrowers disappeared, despite LVIT art. 19 requiring that federation's prior opinion.

Extracted holding

Yes. The Department could request the AOVG's opinion because it can take over the role formerly played by the Federation of Winegrowers.

Extracted reasoning

The disappearance of the federation did not frustrate the consultation mechanism; the AOVG was an adequate functional substitute for the required pre-opinion.

Key legal question

Whether the use of the viticulture fund by the AOVG complied with LVIT, including politically oriented spending.

Extracted holding

The fund's use by the AOVG complied with LVIT, although the use of funds for political campaigns remained open to criticism.

Extracted reasoning

The court accepted the statutory conformity of the fund's management and did not treat the political use criticism as establishing illegality.
