The case concerned the legality of authorizing four lighting masts on a football pitch located in a green zone equipped for sports. The court held that the installation was consistent with the zoning regime and with the permitted sporting use of the site. The challenged authorization was therefore upheld.
LALAT art. 24 para. 4; land-use compatibility of sporting equipment in a green zone with sports facilities. Installations serving the operation of a permitted sports facility may be authorized where they remain accessory to that use and do not alter the zone’s character. Lighting masts for a football field form part of the functional equipment of the sports installation and are, in principle, compatible with the zoning designation, absent a specific legal prohibition or a disproportionate encroachment on the protected use of the area.
