Omnilex summary

The court examined whether a four-star hotel could be enlarged by derogation under LDTR art. 8 and whether a monetary compensatory contribution for a HLM housing project was permissible. It accepted that the hotel enlargement was useful for visitors and the local economy, but held that derogation failed because the transformed building did not have the precarious character required cumulatively by the statute. It also held that LDTR art. 8 allows only in-kind compensation by simultaneous reallocation of commercial or administrative surfaces, not financial contributions.

Omnilex headnote

LDTR art. 8; derogatory authorization for a change of use and enlargement of premises; cumulative conditions and admissible compensation. A derogation may be granted only if the statutory conditions are cumulatively satisfied; the desirability or neighborhood compatibility of a project is insufficient where the transformed building does not present the precarious situation contemplated by the provision. Compensation under art. 8 is limited to in-kind compensation through simultaneous reaffectation of commercial or administrative surfaces; financial compensation is excluded.

Extracted by Omnilex

Key legal question

Whether the enlargement of a four-star hotel could be authorized by derogation under LDTR art. 8.

Extracted holding

The enlargement could be considered desirable and compatible with neighborhood conditions, but authorization was refused because the building to be transformed lacked the precarious character required cumulatively for the derogation.

Extracted reasoning

Art. 8 para. 1 allows a derogation only if the project is useful for visitors and economic activity and the transformed building presents a precarious situation making housing conditions uncertain; both conditions must be met.

Key legal question

Whether compensatory financial participation for constructing a HLM residential building was admissible under LDTR art. 8.

Extracted holding

No. LDTR art. 8 permits only in-kind compensation through simultaneous reallocation of commercial or administrative space, not financial compensation.

Extracted reasoning

The statute confines compensation to a simultaneous change of use of existing surfaces; monetary participation is outside the permitted forms.
