Résumé

"Il ressort de ce qui précède que le système actuel d'obligation absolue et inconditonnelle d'affiliation à une centrale ne constitue une mesure ni adéquate ni nécessaire pour s'assurer de l'existence d'un système de diffusion d'ordres de courses permanent sur l'ensemble du canton, car les centrales importantes disposent de toute façon de suffisamment de candidats à l'affiliation. Dans la mesure où elle ne sert qu'à"assurer la survie des petites centrales, l'obligation d'affiliation constitue dès lors une mesure de politique économique visant à favoriser des entreprises particulières. Il résulte de ce qui précède que l'obligation d'affiliation à une centrale, telle qu'elle est prévue actuellement, viole l'art. 31 Cst féd.". L'obligation absolue et inconditionnelle, imposée aux exploitants de taxis avec permis de stationnement, de s'affilier à une centrale de diffusion d'ordres de courses agréée par le Département de justice et police et des transports, constitue une restriction de leur liberté économique qui viole le principe de la proportionnalité: les centrales principales de diffusion de courses n'ont pas besoin de l'obligation d'affiliation pour avoir suffisamment d'abonnés pour assurer le service, reconnu d'intérêt public, de diffusion d'ordres de courses permanent, sur l'ensemble du canton. Dans la mesure où elle ne sert qu'à assurer la survie des petites centrales, l'obligation d'affiliation constitue une mesure de politique économique visant à favoriser des entreprises particulières.
