2.2 Gemäss Art. 270 lit. b StPO darf der Fernmeldeanschluss von Drittpersonen überwacht werden, wenn auf Grund bestimmter Tatsachen angenommen werden muss, dass die beschuldigte Person den Fernmeldeanschluss der Drittperson benutzt oder die Drittperson für die beschuldigte Person bestimmte Mitteilungen entgegennimmt oder von dieser stammende Mitteilungen an eine weitere Person weiterleitet.

In seiner bisherigen Praxis hat das Zwangsmassnahmengericht festgehalten, dass die Überwachung des Anschlusses einer Drittperson, welcher von der beschuldigten Person nicht wie ein eigener benutzt wird, nur im Rahmen einer sog. "Notsuche" gemäss Art. 3 BÜPF zulässig ist. Das heisst, eine Drittüberwachung ist nicht möglich, wenn lediglich der Verdacht besteht, dass die beschuldigte Person auf den Anschluss der zu überwachenden Drittperson anrufen wird. In seinem Entscheid vom 6. November 2012 (BG. E 138 IV 232 E.  6.3  ) hat das Bundesgericht festgehalten, dass die Überwachung eines Drittanschlusses gemäss Art. 270 lit. b Ziff. 1 StPO möglich ist, wenn hinreichende Anhaltspunkte bestehen, dass die beschuldigte Person darauf anrufen wird. In diesen Fällen ist jedoch die Verhältnismässigkeit aufgrund der konkreten Verhältnisse besonders genau zu prüfen.

Die Voraussetzungen der Überwachung einer Drittperson sind vorliegend gegeben, ist doch davon auszugehen, dass X. [Drittperson] über sein Telefon Mitteilungen von Unbekannt entgegengenommen hat, das heisst, dass Unbekannt auf diesen Anschluss angerufen hat. Die Überwachung ist lediglich für einen kurzen Zeitraum (wenige Stunden) vor und nach der mutmasslichen Tat angeordnet worden, so dass die Verhältnismässigkeit gewahrt wird.

2.3 (…) Somit ist nicht auszuschliessen, dass dieser Anruf in einem Zusammenhang mit dem Tötungsdelikt steht.

Nach den Gesuchsakten sind die Voraussetzungen für eine rückwirkende Überwachung der Rufnummer xyz des Festnetzanschlusses von X. in der Untersuchung gegen Unbekannt demzufolge erfüllt, wird dieser doch dringend der Begehung eines Verbrechens (Art. 111 StGB) verdächtigt. Die Schwere der strafbaren Handlung rechtfertigt eine rückwirkende Randdatenerhebung des Telefonanschlusses (lit. b). In Übereinstimmung mit den Vorbringen der Staatsanwaltschaft ist gestützt auf die derzeitige Akten- und Sachlage davon auszugehen, dass die Ermittlungen ohne diese Überwachung unverhältnismässig erschwert würden (lit. c).
