Entscheid des Kantonsgerichts Basel-Landschaft vom 21. Dezember 2004 (100 04 209)

Ist die Staatsanwaltschaft nur durch das strafgerichtliche Urteil als solches, nicht aber durch die vom Opfer ergriffene Appellation belastet, kann sie wohl gegen das Urteil selbst die Appellation erklären, ist aber nicht zur Erhebung einer Anschlussappellation legitimiert (§ 183 Abs. 1 StPO; E. 1).

Gemäss § 183 Abs. 1 StPO kann die durch die Appellation belastete Partei innert 5 Tagen seit der Mitteilung des Strafgerichtspräsidiums über die Ergreifung der Appellation die Anschlussappellation erklären. Am 19. Dezember 2003 erhob die Staatsanwaltschaft Anschlussappellation bezüglich D. M. Allerdings macht die Staatsanwaltschaft zu keinem Zeitpunkt geltend, inwieweit sie durch die Appellation - und nicht etwa durch das strafgerichtliche Urteil als solches - belastet ist. Vielmehr beantragt die Staatsanwaltschaft dasselbe wie das Opfer in seiner Appellation, nämlich einen Schuldspruch des Appellaten 2 wegen fahrlässiger schwerer Körperverletzung. Wesenselement der Anschlussappellation ist jedoch, dass die anschlussappellierende Partei durch dieAppellationbelastet sein muss, nicht durch das appellierte Urteil als solches (vgl. dazu bereits die unterschiedliche Terminologie von § 177 und § 183 Abs. 1 StPO). Der Sinn der Anschlussappellation liegt nicht darin, eine bestehende Appellation zu "verstärken", sondern ebenfalls Parteistellung in einem Appellationsverfahren zu erlangen, dessen Hauptappellation die eigenen Interessen nachteilig beeinträchtigen könnte. Die Staatsanwaltschaft könnte wohl Appellation gegen das strafgerichtliche Urteil als solches erheben, ist aber durch die Appellation des Opfers nicht belastet und deshalb nicht zur Erhebung einer Anschlussappellation legitimiert. Auf diese ist deshalb nicht einzutreten.
