Omnilex summary

Mutuel Assurances withdrew its administrative-law appeal against the Geneva administrative court judgment of 13 July 2006. The Federal Insurance Court therefore struck the case from the docket. It held that the respondents’ reply could not be considered because they did not submit a requested power of attorney in time, so no party costs were awarded. In view of the withdrawal, the court also waived judicial costs and ordered the repayment of the CHF 500 advance on costs to the appellant.

Omnilex headnote

Withdrawal of appeal; discontinuance of proceedings. In federal insurance proceedings, a withdrawal of the appeal is treated as a discontinuance of the action and leads to removal of the case from the docket (consid. 1). Where the respondent’s submission is not accompanied by the requested authority to act, it need not be considered; in such circumstances no party compensation is due (Art. 30 al. 2 in relation with Art. 135 OJ). Following discontinuance, judicial costs may be waived and any advance on costs refunded (Art. 153 al. 2 in relation with Art. 135 OJ).

Instance précédente
Tribunal administratif de la République et canton de Genève, Genève

(Jugement du 13 juillet 2006)

Considérant:
que par lettre du 14 décembre 2006, Mutuel Assurances a déclaré retirer le recours de droit administratif qu'elle avait interjeté le 22 août 2006 contre l'ordonnance rendue le 13 juillet 2006 par le Tribunal administratif de la République et canton de Genève;

que le retrait de recours est assimilé à un désistement d'instance (ATF 111 V 60 consid. 1);

qu'en procédure fédérale, les intimés ont déposé un mémoire de réponse le 5 octobre 2006, par l'intermédiaire de l'Association suisse des assurés (ASSUAS);

que les intimés n'ont toutefois pas donné suite à l'invitation du Tribunal fédéral des assurances de produire une procuration dans le délai fixé (courrier du 11 octobre 2006);

qu'il n'y a dès lors pas lieu de tenir compte de l'écriture des intimés, ni par conséquent de leur allouer des dépens (art. 30 al. 2 en corrélation avec l'art. 135 OJ);

Key legal question

Whether the appeal should be struck out after the appellant withdrew it.

Extracted holding

The case was removed from the docket following the withdrawal of the appeal, which is treated as a discontinuance.

Extracted reasoning

A withdrawal of the appeal is assimilated to a discontinuance of proceedings; therefore the federal proceedings ended without a merits review.

Key legal question

Whether the respondents' reply should be taken into account and whether costs should be awarded to them.

Extracted holding

The respondents' filing was disregarded because they failed to produce the requested power of attorney; consequently no party costs were awarded.

Extracted reasoning

Without compliance with the court's invitation to file a proxy within the deadline, the written submission could not be considered, and no indemnity for costs was due.

Key legal question

Whether court fees should be charged after the withdrawal of the appeal.

Extracted holding

No court fees were levied.

Extracted reasoning

Given the discontinuance of the proceedings, the court waived the collection of judicial costs.
