Omnilex summary

S.________ appealed to the Federal Insurance Court against a decision of the Zurich Social Insurance Court. Because the case did not concern the grant or refusal of insurance benefits, it was subject to costs. The court ordered an advance payment of CHF 500 and warned that failure to pay would result in non-entry. The order was served on 1 December 2005, but the advance was not paid within the deadline. The court therefore did not enter into the appeal and, in line with its practice for such cases, imposed no court costs.

Omnilex headnote

Art. 134 OG e contrario, Art. 150 Abs. 4 OG; non-payment of the ordered advance on costs after proper warning leads to non-entry into the appeal. Where the advance is not paid within the set time limit, the court must apply the threatened consequence; in proceedings that are otherwise cost-bearing, no court costs are levied as a rule when non-entry is pronounced for failure to pay the advance (consid. 1).

Key legal question

Whether the administrative law appeal had to be entered into despite non-payment of the advance on costs

Extracted holding

The court did not enter into the appeal because the advance on costs was not paid within the set time limit.

Extracted reasoning

The case was not about granting or refusing insurance benefits, so it was subject to costs. After the appellant was warned that failure to pay the CHF 500 advance would lead to non-entry, and the advance was still unpaid after service of the order, the court applied Art. 150(4) OG.

Key legal question

Whether court costs should be charged despite the non-entry decision

Extracted holding

No court costs were imposed.

Extracted reasoning

Although the proceedings were in principle cost-bearing, the court followed its practice of not charging costs when it issues a non-entry decision because the advance on costs was not paid or was paid late.
