Omnilex summary

S. appealed an IV matter to the Federal Supreme Court against a cantonal judgment. The court ordered a CHF 500 advance on costs and warned that non-payment would lead to non-entry. The advance was not paid within the deadline, even accounting for the statutory suspension of time limits. The Federal Supreme Court therefore did not enter into the appeal and, following its practice, imposed no court costs.

Omnilex headnote

Art. 150 OG; failure to pay the ordered advance on costs within the deadline despite warning of non-entry leads to inadmissibility of the appeal; the time-limit suspension under Art. 34 Abs. 1 OG must be taken into account when calculating the deadline. In proceedings subject to costs under Art. 134 OG, the court may require an advance and, absent timely payment, must refuse entry under Art. 150 Abs. 4 OG (consid. 1). In non-entry cases caused by non-payment of the advance, court costs are as a rule waived as a matter of practice (consid. 1).

Extracted by Omnilex

Key legal question

Whether the administrative law appeal could proceed despite non-payment of the ordered court advance within the deadline.

Extracted holding

No. Because the advance payment was not made in time, the court had to declare the appeal inadmissible.

Extracted reasoning

The case was subject to costs under the applicable OG rules, an advance was ordered with a clear warning of non-entry, and the advance remained unpaid even considering the statutory suspension of time limits.

Key legal question

Whether court costs should be charged despite the non-entry decision.

Extracted holding

No court costs were levied as a matter of practice in non-entry decisions caused by failure to pay the advance.

Extracted reasoning

Although the proceedings were in principle costs-bearing, the court stated its practice of waiving court costs when non-entry results from missing or late payment of the advance.
