Omnilex summary

K. appealed to the Federal Supreme Court against a judgment of the Cantonal Court of Basel-Landschaft in a social insurance matter. The court refused legal aid, ordered an advance payment of CHF 1,300, and warned that failure to pay would lead to non-entry. The decision was received on 4 June 2007, but the advance was not paid within the deadline. The Federal Supreme Court therefore did not enter into the complaint. It also waived court costs in accordance with its practice for non-entry decisions based on unpaid advances.

Omnilex headnote

Art. 150 Abs. 4 OG; non-payment of an ordered advance of costs after express warning leads to non-entry on the appeal. Where the court has clearly indicated the procedural consequence and the amount is not paid within the prescribed period, the appeal is not examined on the merits. In such non-entry cases, even if the proceedings are in principle chargeable, the Federal Court may exceptionally refrain from levying court costs according to established practice (consid. 1-2).

In Erwägung,

Key legal question

Whether the administrative law complaint had to be entered into despite non-payment of the court advance.

Extracted holding

The complaint could not be heard because the advance payment was not made within the set time limit.

Extracted reasoning

The court had warned that failure to pay the advance would lead to non-entry. Since the amount was not paid in time, Art. 150(4) OG had to be applied.

Key legal question

Whether court costs should be charged despite the non-entry decision.

Extracted holding

No court costs were imposed.

Extracted reasoning

Although the proceedings were in principle subject to costs, the court applied its practice of not levying costs when it declines to enter because the advance payment was not made or was late.
