Non-entry due to unpaid cost advance in social insurance appeal

H 229/04Federal Supreme Court / Social Insurance Division IIMay 2, 2005Inadmissible

Omnilex summary

B.________ appealed a cantonal social insurance judgment to the Federal Insurance Court. Because the case did not concern insurance benefits, a cost advance of CHF 1,900 was ordered. Legal aid was refused, but a further 14-day deadline to pay the advance was granted. The appellant did not pay within the deadline. The court therefore, under Art. 150(4) OG, declined to enter into the appeal and did not charge court costs.

Omnilex headnote

Art. 134 OG e contrario, Art. 150 Abs. 4 OG; non-payment of the ordered cost advance after expiry of the set and extended deadline leads to non-entry on the appeal. Where the appeal does not concern the grant or denial of insurance benefits, the proceeding is fee-bearing; if the advance remains unpaid despite warning, the court must decline to hear the case. In practice, no court costs are levied in non-entry decisions caused by failure or lateness in paying the advance (consid. 1-2).

(Entscheid vom 20. Oktober 2004)

In Erwägung,

Key legal question

Whether the administrative-law appeal had to be entered into despite non-payment of the ordered cost advance.

Extracted holding

No. Because the appellant failed to pay the cost advance within the extended deadline, the court could not enter into the appeal.

Extracted reasoning

The procedure was not about insurance benefits and was therefore fee-bearing. After the cost advance was ordered and a further grace period was granted following the refusal of legal aid, the appellant still did not pay; consequently, the court applied Art. 150(4) OG and declined to hear the case.

Key legal question

Whether court costs should be charged despite the non-entry decision.

Extracted holding

No court costs were imposed, following the court's consistent practice in non-entry decisions caused by missing or late payment of the advance.

Extracted reasoning

Although the case was in principle fee-bearing, the court stated that in such non-entry decisions it does not collect court costs as a matter of practice.
