Omnilex summary

W. filed an administrative law appeal against a decision of the Administrative Court of the Canton of Zug. The Federal Insurance Court ordered him to pay an advance on costs of CHF 1,300 and warned that failure to pay would lead to non-entry. The advance was not paid within the deadline, even taking the statutory suspension of time limits into account. The court therefore refused to enter into the appeal and, in line with practice, waived court costs.

Omnilex headnote

Art. 134 OG e contrario; Art. 150 Abs. 4 OG: Where proceedings do not concern the grant or denial of insurance benefits, they are in principle subject to costs, and the court may require an advance on costs under threat of non-entry. If the advance is not paid within the prescribed period, non-entry follows mandatorily. In such cases, despite the cost-bearing nature of the proceedings, court costs are as a rule not imposed when non-entry is caused by the failure to pay the advance in time (consid. 1).

In Erwägung,

Key legal question

Whether the administrative law appeal had to be entered into despite non-payment of the advance on costs.

Extracted holding

No. Because the advance on costs was not paid within the set time limit, the court had to refuse to enter into the appeal.

Extracted reasoning

The proceedings were not about insurance benefits and were therefore subject to costs. After the appellant was ordered to pay an advance and warned of non-entry, and the advance still was not paid even հաշkening the statutory suspension of deadlines, Art. 150(4) OG required non-entry.

Key legal question

Whether court costs should be levied for the non-entry decision.

Extracted holding

No court costs were charged, although the proceedings were in principle subject to costs.

Extracted reasoning

As a matter of practice, no court costs are imposed when non-entry results from failure or late payment of the advance on costs.
