Omnilex summary

P.__________ filed an administrative appeal against a cantonal insurance court decision. The Federal Insurance Court ordered an advance on costs, rejected an ensuing request for free legal aid as manifestly hopeless, and granted an additional deadline. As the advance was still not paid, the court held that it had to decline to enter into the appeal under Art. 150 Abs. 4 OG. Consistent with its practice, it ordered that no court costs be levied.

Omnilex headnote

Art. 134 OG e contrario; Art. 150 Abs. 4 OG: Where proceedings are not concerned with the grant or denial of insurance benefits, the appeal is subject to costs and the court may require an advance payment. If the party fails to pay the advance within the set deadline, the court must not entertain the appeal. Following established practice, no court costs are levied in non-entry decisions based solely on the untimely or omitted payment of the advance.

Vorinstanz
Versicherungsgericht des Kantons St. Gallen, St. Gallen

(Entscheid vom 26. August 2004)

In Erwägung,

Key legal question

Whether the court could enter into the administrative appeal despite non-payment of the ordered advance costs.

Extracted holding

No. Because the advance costs were not paid within the extended deadline, the court had to decline to hear the appeal.

Extracted reasoning

The appeal was cost-bearing under Art. 134 OG e contrario. After the advance costs order and the failed legal-aid request, the appellant still did not pay within the set time limit; under the warning and Art. 150 Abs. 4 OG, non-entry followed.

Key legal question

Whether court costs should be charged despite the non-entry decision.

Extracted holding

No court costs were imposed.

Extracted reasoning

Although the proceedings were in principle cost-bearing, the court’s practice is not to charge court costs when it issues a non-entry decision because advance costs were not paid or were paid late.
