Omnilex summary

The appellant, represented by counsel, challenged a Federal Administrative Court decision declaring his disability insurance appeal inadmissible. The Federal Supreme Court held that his own federal complaint did not address the non-entry ruling at all, but instead dealt with the merits of the underlying insurance dispute. Because the submission failed to satisfy the reasoning requirements of Art. 42 BGG, the Court refused to enter into the appeal in simplified proceedings under Art. 108(1)(b) BGG. No court costs were levied.

Omnilex headnote

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG; an appeal against a non-entry decision must specifically challenge the reasons for non-entry and, in concise form, show how those reasons violate federal law. A submission that addresses only the substantive merits of the underlying dispute is not a legally sufficient reasoned appeal and leads to non-entry in simplified proceedings (consid. 1). Under Art. 66 Abs. 1 second sentence BGG, the court may waive costs where the circumstances so warrant (consid. 2).

Gegenstand
Invalidenversicherung,

Beschwerde gegen den Entscheid des Bundesverwaltungsgerichts
vom 3. Juni 2008.

Nach Einsicht
in die von B.________ erhobene Beschwerde vom 11. November 2008 gegen den Nichteintretensentscheid des Bundesverwaltungsgerichts vom 3. Juni 2008,

in Erwägung,

Key legal question

Whether the appeal met the minimum substantiation requirements under Art. 42 BGG.

Extracted holding

No. The brief did not engage, even minimally, with the challenged non-entry decision and therefore lacked a legally sufficient reasoned appeal.

Extracted reasoning

An appeal must state the prayers for relief and reasons showing how the challenged act violates the law. In a challenge to a non-entry decision, a submission that only discusses the merits of the underlying dispute is not a proper legal argument against the non-entry ruling.

Key legal question

Whether the appeal should be entered into under the simplified procedure of Art. 108(1)(b) BGG.

Extracted holding

No. Because the appeal was manifestly insufficiently reasoned, the President could not enter into it in simplified proceedings.

Extracted reasoning

The lack of any substantive confrontation with the lower court's non-entry decision made the inadmissibility apparent.

Key legal question

Whether court costs should be charged.

Extracted holding

No court costs were imposed.

Extracted reasoning

The Federal Supreme Court waived costs under Art. 66(1) second sentence BGG.
