Omnilex summary

The Federal Supreme Court dealt with an appeal in invalidity insurance against a cantonal judgment. The appellant's submission only referred to arguments made in the cantonal proceedings and did not engage with the reasoning of the lower court. The court held that the appeal failed to satisfy the reasoning requirements of Art. 42 BGG and did not show any manifestly incorrect finding of fact under Art. 97 Abs. 1 BGG. In simplified proceedings, the court therefore declined to enter into the appeal and waived court costs.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b and Abs. 2 BGG; inadmissibility for insufficient reasoning of the appeal. A federal appeal must set out, in concise form, which parts of the challenged decision are contested and why it is unlawful; a mere reference to earlier submissions does not satisfy this burden. The appellant must engage with the lower court's reasoning and show, where fact findings are attacked, that they are manifestly incorrect and legally relevant. If these requirements are not met, the court may decline to enter in simplified proceedings. Costs may exceptionally be waived under Art. 66 Abs. 1 BGG.

Beschwerde gegen den Entscheid des Versicherungsgerichts des Kantons Aargau
vom 15. Oktober 2013.

Oktober 2013,

in Erwägung,

Key legal question

Whether the federal appeal satisfied the reasoning requirements of Art. 42 BGG and could be examined on the merits.

Extracted holding

The appeal did not contain an adequate discussion of the cantonal judgment and therefore did not meet the statutory reasoning requirements.

Extracted reasoning

A legal remedy must state the requests and reasons in a concise form showing how the challenged decision violates the law. A mere reference to prior submissions is insufficient, and the appeal did not explain why the findings on the medical facts were manifestly incorrect or legally flawed.

Key legal question

Whether court costs should be charged despite inadmissibility.

Extracted holding

No court costs were charged due to the circumstances.

Extracted reasoning

The court expressly waived the collection of judicial costs.
