Omnilex summary

The Swiss Federal Court, in a simplified procedure, held that the appeal against the Federal Administrative Court's judgment was inadmissible. The appellant failed to cure the formal defect of not submitting the lower-court decision within the deadline set by the court and also failed to meet the minimum reasoning requirements. Given the circumstances, the court waived judicial costs.

Art. 42 cpv. 2 e 5 LTF; art. 108 cpv.

Composizione
Giudice federale U. Meyer, Presidente,
cancelliere Grisanti.

Partecipanti al procedimento
L.________, Italia, patrocinato da Patronato INAS, Istituto Nazionale assistenza Sociale, Italia,
ricorrente,

contro

Ufficio AI per gli assicurati residenti all'estero, avenue Edmond-Vaucher 18, 1203 Ginevra,
opponente.

Oggetto

108 cpv. 1 lett. a, b LTF),
66 cpv. 1 in fine LTF),

per questi motivi, il Presidente pronuncia:

1.
Il ricorso è inammissibile.

2.
Non si prelevano spese giudiziarie.

3.

Key legal question

Whether the appeal was admissible despite the missing lower-court decision and deficient reasoning

Extracted holding

The appeal was inadmissible because the appellant did not cure the missing attachment defect within the set deadline and the filing manifestly failed to meet the minimum reasoning requirements.

Extracted reasoning

The appellant did not remedy the formal defect under Art. 42(5) LTF within the period set by the court. In addition, the appeal did not meet the minimum reasoning standard under Art. 42(2) LTF, so summary non-entry was warranted under Art. 108(1)(a)-(b) LTF.

Key legal question

Whether court costs should be charged

Extracted holding

No court costs were charged in view of the circumstances, despite the general rule that costs are ordinarily due.

Extracted reasoning

The court exercised its discretion under Art. 66(1) LTF and waived judicial fees.
