Non-entry for insufficient appeal reasoning in AVS case

Omnilex summary

The appellant challenged the Zurich Social Insurance Court’s decision concerning non-employed AVS contributions for 2010. The Federal Supreme Court held that the appeal did not meet the minimum requirements of Art. 42 BGG because it lacked an admissible request and any substantive discussion of the decisive reasons of the lower court. In simplified procedure, the court therefore did not enter into the appeal. It also waived court costs.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b and Abs. 2 BGG; non-entry for manifestly insufficient reasoning. A federal appeal must contain conclusions and a concise statement of reasons showing, in relation to the decisive grounds of the challenged decision, in what respect the law was allegedly violated. Where the submission lacks any legally sufficient request or fails to address the reasoning of the lower court, the appeal is manifestly inadmissible and may be disposed of in simplified procedure by a non-entry decision (consid. 1). If non-entry is pronounced in such circumstances, court costs may exceptionally be waived under Art. 66 Abs. 1 second sentence BGG (consid. 2).

Urteil vom 30. September 2013

II. sozialrechtliche Abteilung

Besetzung
Bundesrichter Meyer, als Einzelrichter,
Gerichtsschreiber Attinger.

Verfahrensbeteiligte
M.________,
Beschwerdeführer,

gegen

Ausgleichskasse des Kantons Zürich, Röntgenstrasse 17, 8005 Zürich,
Beschwerdegegnerin.

Gegenstand
Alters- und Hinterlassenenversicherung,

Beschwerde gegen den Entscheid des Sozialversicherungsgerichts des Kantons Zürich
vom 30. August 2013.

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the appeal satisfied the minimum reasoning requirements under Art. 42 BGG.

Extracted holding

No; the filing contained neither an admissible request nor any substantive engagement with the decisive reasoning of the lower court.

Extracted reasoning

The appellant did not explain in a legally sufficient way why the prior judgment was unlawful, so the mandatory content requirements for a federal appeal were not met.

Key legal question

Whether the Federal Supreme Court could enter into the appeal in simplified procedure under Art. 108 BGG.

Extracted holding

No; the defect was manifest, so non-entry in simplified procedure was appropriate.

Extracted reasoning

Because the appeal was obviously insufficiently reasoned, the court could refuse to consider it under Art. 108(1)(b) and (2) BGG.

Key legal question

Whether court costs should be charged.

Extracted holding

No court costs were levied.

Extracted reasoning

The court waived costs pursuant to Art. 66(1) second sentence BGG.
