Omnilex summary

The complainant challenged a cantonal disability insurance decision before the Federal Supreme Court. The court held that the appeal did not satisfy the reasoning requirements of Art. 42 BGG because it failed to explain any legal error and did not address the cantonal court's reasons. In simplified proceedings, the court therefore did not enter into the appeal under Art. 108(1)(b) BGG, without setting a deadline to remedy the defect. Court costs were waived under Art. 66(1) BGG.

Omnilex headnote

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG; non-entry due to insufficient reasoning of the appeal. An appeal must, in a concise manner, state the relief sought and set out why the challenged decision violates law; a mere repetition of grievances or a failure to engage with the contested reasoning is insufficient. If the minimum reasoning requirements are not met, the Federal Supreme Court may decline to enter in simplified proceedings without fixing a rectification period. Waiver of court costs may be ordered exceptionally under Art. 66 Abs. 1 second sentence BGG.

Extracted holding

No. The filing did not explain, even in summary form, how the challenged decision violated law, and it did not engage with the lower court's reasoning.

Extracted reasoning

Under Art. 42(1)-(2) BGG, an appeal must contain requests and reasons showing in concise form how the decision infringes law. The submission lacked any substantive attack on the cantonal judgment.

Key legal question

Whether the court should enter into the appeal despite the deficient reasoning

Extracted holding

No entry was made in simplified proceedings without granting a time limit to cure the defect.

Extracted reasoning

Because the pleading failed to satisfy the mandatory content requirements, the court applied Art. 108(1)(b) BGG and declined to set a correction deadline.

Key legal question

Whether court costs should be charged

Extracted holding

No court costs were levied due to the circumstances.

Extracted reasoning

The court waived costs under Art. 66(1) second sentence BGG.
