Omnilex summary

The Federal Court dealt with a complaint against a St. Gallen insurance court decision in the field of health insurance. After warning the appellant about formal defects, it held that neither the original complaint nor the later submission contained a proper request or a sufficient legal and factual reasoning. Because the minimum requirements of Art. 42 BGG were not met, the Court did not enter into the complaint in simplified proceedings. Owing to the circumstances, it waived court costs.

Omnilex headnote

Art. 42 Abs. 1 und 2 BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b BGG; form requirements for a federal complaint and non-entry proceedings: a complaint must contain clear prayers for relief and a reasoned explanation, in condensed form, of how the challenged decision violates law; a merely formal or incomprehensible submission does not satisfy the minimum requirements. A supplementary filing may cure defects only within the appeal period. If the pleading remains insufficient, the Court may refuse to enter in simplified proceedings. Costs may exceptionally be waived under Art. 66 Abs. 1 sentence 2 BGG.

Bundesrichter U. Meyer, Präsident,
Gerichtsschreiber R. Widmer.

Verfahrensbeteiligte
W.________,
Beschwerdeführer,

gegen

CSS Kranken-Versicherung AG, Recht & Compliance, Tribschenstrasse 21, 6005 Luzern,
Beschwerdegegnerin.

Gegenstand
Krankenversicherung,

Beschwerde gegen den Entscheid des Versicherungsgerichts des Kantons St. Gallen
vom 11. August 2011.

Nach Einsicht
in die Beschwerde vom 12. September 2011 (Poststempel) gegen den Entscheid des Versicherungsgerichts des Kantons St. Gallen vom 11. August 2011,
September 2011 (Poststempel) eingereichte Eingabe,

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the complaint met the formal requirements of Art. 42 BGG, including a proper request and substantiated reasoning.

Extracted holding

No. The two submissions did not contain a legally sufficient request and did not explain, in a reviewable way, why the factual findings or legal reasoning of the lower court were wrong.

Extracted reasoning

A federal complaint must state its requests and reasoning concisely; here the submissions failed to satisfy the minimum content requirements, and any challenge to the facts under Art. 97 para. 1 BGG was not adequately articulated.

Key legal question

Whether the Court should enter into the complaint in simplified proceedings under Art. 108 para. 1 lit. b BGG.

Extracted holding

No. Because the complaint was manifestly non-compliant with the formal requirements, the President declined entry in simplified proceedings.

Extracted reasoning

The insufficiency of the pleadings justified a non-entry decision without full proceedings.

Key legal question

Whether court costs should be charged.

Extracted holding

No court costs were imposed in light of the circumstances.

Extracted reasoning

The Court waived costs under Art. 66 para. 1 sentence 2 BGG.
