Omnilex summary

D. filed a complaint in an invalidity insurance dispute against the Zurich cantonal social insurance court’s decision concerning an invalidity pension and medical measures. The Federal Court held that the complaint did not meet the minimum reasoning requirements because it failed to address the decisive grounds of the cantonal judgment. In simplified procedure, it therefore declined to enter into the complaint. No court costs were imposed, which rendered the request for exemption from costs moot. The request for free legal representation was denied because the complaint had no prospect of success.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b BGG; Art. 66 Abs. 1 BGG: a complaint must contain a concise submission explaining how the challenged decision violates the law; a merely formal filing without substantive engagement with the lower court’s decisive reasoning is manifestly insufficient and permits non-entry in simplified procedure. Where no court costs are levied, a request for exemption from costs becomes moot. Free legal representation requires, inter alia, sufficient prospects of success; if the complaint is evidently doomed to fail, the request must be refused.

Urteil vom 5. Oktober 2007
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiber Attinger.

Parteien
D.________, Beschwerdeführerin,

gegen

IV-Stelle des Kantons Zürich, Röntgenstrasse 17, 8005 Zürich, Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the federal complaint met the minimum reasoning requirements under Art. 42 BGG.

Extracted holding

It did not; the filing lacked an adequate substantive challenge to the decisive reasoning of the lower court.

Extracted reasoning

The complaint contained no discernible engagement with the decisive considerations of the cantonal judgment and therefore failed the statutory minimum requirements for a reasoned appeal.

Key legal question

Whether the complaint should be entered into under the simplified procedure of Art. 108(1)(b) BGG.

Extracted holding

No entry was made because the complaint was manifestly insufficiently reasoned.

Extracted reasoning

Given the obvious failure to satisfy the reasoning requirement, the President could dispose of the matter summarily by non-entry.

Key legal question

Whether court costs should be charged and whether the request for fee waiver became moot.

Extracted holding

No court costs were charged; the request for exemption from court costs was therefore moot.

Extracted reasoning

The court ordered that no judicial costs be levied, making the request for free judicial assistance in the form of cost exemption without object.

Key legal question

Whether free legal representation should be granted.

Extracted holding

The request was denied because the complaint had no prospects of success.

Extracted reasoning

Since the complaint was destined to fail from the outset, the condition of arguable chances of success for free legal counsel was not met.
