Omnilex summary

B.________ appealed to the Federal Supreme Court against a cantonal judgment concerning entitlement to a disability pension. The complaint did not contain any request or any meaningful discussion of the decisive cantonal reasoning, in particular the finding that the minimum contribution period for an ordinary disability pension and the requirements for an extraordinary pension were not met. The Federal Supreme Court therefore did not enter into the appeal in simplified procedure. It also waived court costs.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b BGG; admissibility of a federal complaint. A remedy must contain requests and, in concise form, reasoning showing how the challenged decision violates the law. If the submission does not engage with the decisive considerations of the lower court, it is manifestly insufficiently reasoned and the court may decline to enter into the matter in simplified procedure. Under Art. 66 Abs. 1 second sentence BGG, court costs may be waived.

Urteil vom 31. Januar 2012
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiber Attinger.

Verfahrensbeteiligte
B.________,
Beschwerdeführer,

gegen

IV-Stelle Basel-Landschaft,
Hauptstrasse 109, 4102 Binningen,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

Dezember 2011.

Nach Einsicht
in die Beschwerde vom 22. Januar 2012 (Datum des Poststempels) gegen den Entscheid des Kantonsgerichts Basel-Landschaft, Abteilung Sozialversicherungsrecht, vom 1. Dezember 2011 betreffend Invalidenrente,
in Erwägung,

Luzern, 31. Januar 2012

Extracted by Omnilex

Key legal question

Whether the federal complaint met the minimum reasoning requirements under Art. 42 BGG.

Extracted holding

No. The filing contained neither a request nor a substantive challenge to the decisive reasoning of the cantonal court.

Extracted reasoning

A remedy must state requests and briefly explain how the challenged decision violates the law. The appellant's submission manifestly failed to do so.

Key legal question

Whether the complaint could be examined under the simplified procedure of Art. 108(1)(b) BGG.

Extracted holding

No entry was possible because the complaint was manifestly insufficiently reasoned.

Extracted reasoning

Given the clear failure to satisfy the formal admissibility requirements, the president could decide not to enter into the matter in simplified procedure.

Key legal question

Whether court costs should be charged.

Extracted holding

No court costs were levied.

Extracted reasoning

The court waived costs under Art. 66(1) second sentence BGG.
