Omnilex summary

The Federal Supreme Court did not enter into the appeal against the cantonal decision on supplementary benefits. The appeal was filed after expiry of the 30-day deadline, which had lapsed on 15 June 2009, and the submission also lacked the reasoning required by the Federal Supreme Court Act. The request for free legal representation was refused. No court costs were charged.

Omnilex headnote

Art. 100 Abs. 1, 42 Abs. 2, 64 Abs. 1 and 66 Abs. 1 BGG; timeliness and substantiation requirements for an appeal to the Federal Supreme Court. An appeal filed after expiry of the statutory period is inadmissible and must be rejected in summary proceedings under Art. 108 Abs. 1 lit. a BGG. Independently, an appeal that manifestly lacks the reasoning required by Art. 42 Abs. 2 BGG is likewise incapable of being heard under Art. 108 Abs. 1 lit. b BGG. Where the remedy is inadmissible, a request for free legal assistance is to be refused. The Court may waive the levying of costs under Art. 66 Abs. 1 second sentence BGG.

Urteil vom 3. Juli 2009
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiberin Dormann.

Parteien
R.________,
Beschwerdeführer,

gegen

Sozialversicherungsanstalt des Kantons St. Gallen, Brauerstrasse 54, 9016 St. Gallen,
Beschwerdegegnerin.

Gegenstand

Mai 2009,
in Erwägung,
