Omnilex summary

The Federal Court considered an appeal against a cantonal AHV judgment concerning contribution liability for 2005 and 2006. It held that the appeal failed to meet the mandatory formal requirements because it contained no proper request and did not meaningfully explain why the cantonal findings or reasoning were unlawful. Applying the simplified procedure, the court declined to enter into the appeal without granting time to remedy the defects. It also waived court costs.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b BGG: an appeal must contain conclusions and, in concise form, reasons showing how the challenged decision violates federal law. If the submissions do not address the contested factual findings or the legal reasoning in a reviewable manner, the appeal is manifestly insufficiently reasoned and the court may refuse to enter into it in simplified proceedings, without setting a remedy period. Art. 66 Abs. 1 sentence 2 BGG permits waiver of court costs in such circumstances.

Beschwerdegegnerin.

Gegenstand
Alters- und Hinterlassenenversicherung,

Beschwerde gegen den Entscheid des Sozialversicherungsgerichts des Kantons Zürich
vom 29. April 2010.

in Erwägung,

Extracted holding

No cure period was granted.

Extracted reasoning

Given the obvious insufficiency of the appeal, the court proceeded without setting a time limit for rectification and applied simplified procedure.

Key legal question

Whether court costs should be charged.

Extracted holding

No court costs were levied.

Extracted reasoning

The court waived costs under Art. 66 Abs. 1 Satz 2 BGG.
