Omnilex summary

G.________ appealed a cantonal social insurance judgment in a health insurance dispute against CSS Kranken-Versicherung AG. The Federal Supreme Court held in simplified procedure that the submission failed to meet the mandatory reasoning requirements of Art. 42 BGG because it did not engage with the decisive findings of the cantonal court or explain any legal error. As a result, the court did not enter into the appeal. Because there was no valid appeal, legal aid was refused. Owing to the circumstances, the court waived the charging of court costs.

Omnilex headnote

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG; Art. 64 BGG; Art. 66 Abs. 1 Satz 2 BGG: An appeal must contain specific requests and a reasoned, issue-related critique of the challenged decision; it must show, in a manner tailored to the decisive considerations, why the judgment violates federal law. A merely generic or appellatory submission, which fails to address the ratio decidendi or to explain the alleged factual or legal error, is manifestly insufficient and leads to non-entry in simplified procedure (consid. 1). In the absence of a valid appeal, legal aid is excluded. Court costs may exceptionally be waived where the circumstances so justify.

gegen

CSS Kranken-Versicherung AG, Tribschenstrasse 21, 6005 Luzern,

Gegenstand
Krankenversicherung,

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the appeal met the Federal Supreme Court's minimum reasoning requirements under Art. 42 BGG.

Extracted holding

The appeal did not satisfy the statutory reasoning requirements because it failed to engage with the decisive reasoning of the lower court and did not show any legal error.

Extracted reasoning

An appeal must contain requests and a reasoned explanation showing, in concise form, how the challenged decision violates law; the submission was not issue-focused and did not explain why the findings of fact were incorrect or the legal reasoning unlawful.

Key legal question

Whether legal aid could be granted despite the defective appeal.

Extracted holding

Legal aid was unavailable because no valid and timely appeal was filed.

Extracted reasoning

Without a valid appeal, the prerequisite for unentgeltliche Rechtspflege is missing.

Key legal question

Whether court costs should be charged.

Extracted holding

No court costs were imposed due to the circumstances.

Extracted reasoning

The court exercised discretion under Art. 66(1) sentence 2 BGG and waived costs.
