Non-entry due to insufficiently reasoned appeal

Omnilex summary

The claimant appealed a cantonal social-insurance judgment concerning a new disability-insurance application. The Federal Supreme Court found the appeal manifestly insufficiently reasoned because it did not show, even in summary form, how the cantonal court had violated federal law or made manifestly incorrect factual findings. It therefore declined to enter into the appeal in simplified procedure and waived court costs.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 97 Abs. 1 BGG; Art. 95 BGG; Art. 108 Abs. 1 lit. b and Abs. 2 BGG; inadmissibility for insufficient reasoning. An appeal to the Federal Supreme Court must contain requests and a concise statement of reasons showing how the challenged decision infringes federal law. Where the appellant merely seeks a merits review without addressing the decisive factual findings or legal considerations of the lower court, the appeal is manifestly inadequately reasoned. In such circumstances, the Court may decline to enter into the matter in simplified procedure. Exceptional waiver of court costs remains possible under Art. 66 Abs. 1 second sentence BGG.

Urteil vom 17. Juli 2013

II. sozialrechtliche Abteilung

Besetzung
Bundesrichter Meyer, als Einzelrichter,
Gerichtsschreiberin Dormann.

Verfahrensbeteiligte
P.________,
Beschwerdeführer,

gegen

IV-Stelle des Kantons Zürich, Röntgenstrasse 17, 8005 Zürich,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

Beschwerde gegen den Entscheid des
Sozialversicherungsgerichts des Kantons Zürich
vom 22. Mai 2013.

Mai 2013,

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the appeal satisfied the Federal Supreme Court's minimum reasoning requirements under Art. 42 BGG.

Extracted holding

No. The submissions did not explain, even in outline, why the cantonal court's factual findings were allegedly manifestly incorrect or its reasoning legally erroneous.

Extracted reasoning

An appeal must state requests and reasons, and the reasons must briefly show how the challenged decision violates the law. The filing only requested a merits review of the November 2011 reapplication and failed to address the standards of Art. 97(1) and Art. 95 BGG.

Key legal question

Whether the appeal should be entered into under the simplified procedure.

Extracted holding

No. Because the appeal was plainly insufficiently reasoned, non-entry was appropriate in simplified procedure.

Extracted reasoning

The deficiency was obvious, allowing refusal of entry under Art. 108(1)(b) and (2) BGG.

Key legal question

Whether court costs should be levied.

Extracted holding

No court costs were charged due to the circumstances.

Extracted reasoning

The court waived fees on an exceptional basis under Art. 66(1) second sentence BGG.
