Omnilex summary

G. appealed a Vaud cantonal social-insurance judgment concerning disability insurance. The Federal Supreme Court held that the submission did not satisfy the formal requirements of Art. 42 LTF: it contained only general allegations of deteriorating health and work incapacity, supported by medical documents that did not show any concrete error in the cantonal findings or any manifest violation of law. The appeal was therefore declared inadmissible in simplified procedure. No court costs were imposed.

Omnilex headnote

Art. 42 LTF; inadmissibility of an appeal for insufficient reasoning. A federal appeal must state the conclusions, reasons and evidence and, in a concise manner, explain why the challenged decision violates federal law. Mere general allegations concerning an ухудening medical condition or the filing of medical certificates, without a targeted critique of the lower court’s findings, do not satisfy the requirements of Art. 42 al. 1 and 2 LTF. If the appeal is manifestly non-compliant, the court may dismiss it in simplified proceedings under Art. 108 al. 1 let. b LTF; in such a case, judicial costs may be waived under Art. 66 al. 1 LTF.

Arrêt du 15 juin 2009
IIe Cour de droit social

Composition
M. le Juge U. Meyer, Président.
Greffier: M. Cretton.

Parties
G.________,
recourante,

contre

Office de l'assurance-invalidité pour le canton de Vaud, Avenue du Général-Guisan 8, 1800 Vevey,
intimé.

Objet

Key legal question

Whether the appeal met the federal pleading requirements under Art. 42 LTF and could be heard on the merits.

Extracted holding

The appeal did not sufficiently state the relief sought, reasons, and proof, and did not show why the cantonal findings were inaccurate or contrary to law.

Extracted reasoning

The appellant relied on general assertions of worsening health and work incapacity and on various medical documents, but these did not demonstrate any concrete error in the challenged judgment as required by Art. 42 LTF and Art. 97(1) LTF.
