Omnilex summary

The Federal Supreme Court dismissed as inadmissible an appeal in invalidity insurance proceedings against a 2 May 2011 judgment of the Ticino Insurance Court. It held that the filing did not satisfy the minimum requirements of Art. 42 LTF because it lacked a clear prayer for relief and did not explain why the lower court's findings were manifestly inaccurate or unlawful under Art. 97 LTF. The court decided the matter in simplified procedure under Art. 108(1)(b) LTF and waived court costs under Art. 66(1) LTF.

Omnilex headnote

Art. 42 cpv. 1-2 LTF, art. 97 cpv. 1 LTF, art. 108 cpv. 1 lett. b LTF; requirements of motivation and relief in a federal appeal. An appeal must contain clear conclusions and a concise, substantiated reasoning showing in what respect the challenged decision violates federal law or contains manifestly incorrect factual findings. If these minimum requirements are not met, the court may declare the appeal inadmissible in simplified procedure. Where the appeal is not examined on the merits, court costs may be waived under Art. 66 cpv. 1 seconda frase LTF.

Sentenza del 14 giugno 2011
II Corte di diritto sociale

Composizione
Giudice federale U. Meyer, Presidente,
cancelliere Grisanti.

Partecipanti al procedimento
D.________,
ricorrente,

contro

Ufficio dell'assicurazione invalidità del Cantone Ticino, via Ghiringhelli 15a, 6500 Bellinzona,
opponente.

Oggetto
