Omnilex summary

The complainant challenged a cantonal social insurance judgment in a health insurance dispute. The Federal Court held that the complaint did not satisfy the statutory reasoning requirements because it did not show any manifestly incorrect fact-finding or violation of federal law. Applying the simplified procedure, the Court did not enter into the complaint and waived court costs.

Omnilex headnote

Art. 42 Abs. 1-2 BGG; Art. 97 Abs. 1 BGG; Art. 95 lit. a BGG; Art. 108 Abs. 1 lit. b BGG: a federal complaint must contain, in concise form, the reasons showing how the challenged decision violates law; mere criticism or unsupported assertions are insufficient. If the admissibility requirements are not met, the Federal Court may decline to enter in simplified procedure. Where non-entry is ordered under Art. 108 Abs. 1 lit. b BGG, costs may exceptionally be waived pursuant to Art. 66 Abs. 1 sentence 2 BGG.

Key legal question

Whether the federal complaint met the minimum reasoning requirements under Art. 42 BGG and could be heard.

Extracted holding

The complaint did not explain sufficiently why the cantonal decision was allegedly based on manifestly incorrect fact-finding or otherwise violated federal law.

Extracted reasoning

Under Art. 42(1)-(2) BGG, a remedy must state the relief sought and reasons; the appellant's submissions failed to meet this minimum threshold, so summary non-entry under Art. 108(1)(b) BGG was required.
