Omnilex summary

B.________ appealed a judgment of the Vaud cantonal social insurance court in an invalidity-insurance matter. The Federal Supreme Court held that the appeal did not meet the minimum formal requirements of Art. 42 LTF because it contained no, or insufficient, conclusions and failed to explain why the cantonal findings were wrong or the decision unlawful. The appeal was therefore declared inadmissible in simplified procedure under Art. 108(1)(b) LTF. The request for an additional time limit to complete the appeal and obtain counsel was rejected, and no judicial fees were charged.

Omnilex headnote

Art. 42 al. 1 et 2 LTF, art. 108 al. 1 let. b LTF; requirements of the federal appeal and summary non-entry decision. A federal appeal must contain conclusions and a concise statement of reasons showing why the challenged decision violates the law or is based on manifestly inaccurate findings of fact; mere disagreement is insufficient. If these formal requirements are not met, the court may declare the appeal inadmissible in simplified procedure without inviting supplementation. No extension of time need be granted where the filing is fundamentally deficient. Under art. 66 al. 1 LTF, fees may be waived.

Arrêt du 31 mai 2010
IIe Cour de droit social

Composition
M. le Juge U. Meyer, Président.
Greffier: M. Berthoud.

Participants à la procédure
B.________,
recourant,

contre

Office de l'assurance-invalidité pour le canton de Vaud, Avenue Général-Guisan 8, 1800 Vevey,
intimé.

Objet

que selon l'art. 42 al. 1 et 2 LTF, le recours doit indiquer, entre autres exigences, les conclusions, les motifs et les moyens de preuve, en exposant succinctement en quoi l'acte attaqué est contraire au droit;
qu'en l'occurrence, le recours ne contient pas de conclusions, ou des conclusions insuffisantes;
que l'on ne peut pas en déduire en quoi les constatations des premiers juges seraient inexactes - au sens de l'art. 97 al. 1 LTF -, ni en quoi l'acte attaqué serait contraire au droit;
que, partant, le recours ne répond pas aux exigences de l'art. 42 al. 1 et 2 LTF et n'est pas recevable;
que le recours doit être déclaré irrecevable selon la procédure simplifiée de l'art. 108 al. 1 let. b LTF;
qu'il n'y a pas matière à poursuivre la procédure sous quelque forme que ce soit, notamment en accordant un délai complémentaire au recourant pour préparer ses arguments et rechercher un homme de loi ainsi qu'il le requiert;
