Omnilex summary

A claimant appealed to the Federal Supreme Court against a cantonal decision concerning invalidity insurance job placement. The Federal Court first warned him that his appeal appeared not to satisfy the formal requirements of requests and reasoning, but his subsequent filing still did not address the decisive reasoning of the cantonal court. The appeal was therefore not entered into in simplified procedure. The Court also waived court costs.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b BGG; sufficiency of the statement of reasons for a federal appeal: an appeal must contain requests and, in concise form, an argument showing how the challenged decision violates the law. A merely formal or wholly undeveloped submission that does not engage with the decisive grounds of the cantonal judgment is manifestly insufficient. In such a case, the appeal is inadmissible and may be disposed of in simplified procedure by non-entry (consid. 1). Under Art. 66 Abs. 1 second sentence BGG, court costs may be waived where the circumstances justify it (consid. 2).

Urteil vom 29. Mai 2009
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiber Attinger.

Parteien
A.________, Beschwerdeführer,

gegen

IV-Stelle Bern, Chutzenstrasse 10, 3007 Bern,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

April 2009.

Nach Einsicht
in die von A.________ erhobene Beschwerde vom 1. Mai 2009 gegen den Entscheid des Verwaltungsgerichts des Kantons Bern, Sozialversicherungsrechtliche Abteilung, vom 27. April 2009 betreffend Arbeitsvermittlung,

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the appeal met the minimum formal requirements of Art. 42 BGG.

Extracted holding

The appeal did not contain adequate requests or a sufficiently reasoned challenge to the cantonal court’s decisive reasoning.

Extracted reasoning

The two submissions did not engage with the lower court’s core findings on the refused job placement and therefore failed the statutory requirement to explain in concise form how the contested decision violated the law.

Key legal question

Whether the Federal Court could enter into the appeal under simplified procedure.

Extracted holding

No entry was possible under the simplified procedure because the appeal was manifestly insufficiently reasoned.

Extracted reasoning

Given the obvious failure to satisfy the formal requirements, non-entry followed under the Federal Tribunal Act.
