Omnilex summary

The appellant challenged the Federal Administrative Court judgment confirming the denial of an invalidity pension. The Federal Court held that the appeal did not meet the reasoning requirements of Art. 42 LTF, because it merely listed diagnoses and alleged limitations without demonstrating any legal error in the lower court judgment. The appeal was therefore declared inadmissible in simplified procedure under Art. 108 LTF. In view of the circumstances, the court waived judicial fees under Art. 66 LTF.

Omnilex headnote

Art. 42 LTF; admissibility of a federal appeal; an appeal must contain conclusions, reasons and evidence and must set out, in a concise manner, why the challenged decision violates the law. A mere enumeration of diagnoses or functional limitations, without addressing the lower court's factual findings or legal reasoning, is insufficient. Where the deficiency is manifest, inadmissibility may be pronounced in simplified procedure under Art. 108 para. 1 lit. b and para. 2 LTF. Judicial fees may exceptionally be waived under Art. 66 para. 1 LTF in light of the circumstances.

Arrêt du 17 juin 2014

IIe Cour de droit social

Composition
Greffier : M. Bouverat.

Participants à la procédure
A.________, Espagne,
représenté par Me José Nogueira Esmorís, Avocat, Espagne,
recourant,

contre

Extracted by Omnilex

Key legal question

Whether the federal appeal satisfied the reasoning requirements of Art. 42 LTF.

Extracted holding

No. The appeal merely listed diagnoses and functional limitations without showing why the lower court's findings were wrong or the judgment unlawful.

Extracted reasoning

The appellant did not explain, even briefly, how the contested judgment violated federal law or why the findings of fact were inaccurate, so the submission failed to meet the statutory pleading standard.

Key legal question

Whether the appeal should be dealt with under simplified procedure.

Extracted holding

Yes. The manifest failure to comply with Art. 42 LTF justified inadmissibility in simplified procedure.

Extracted reasoning

Because the defect was obvious from the filing itself, the court could apply the simplified procedure under Art. 108 LTF.

Key legal question

Whether court fees should be charged.

Extracted holding

No fees were charged in view of the circumstances.

Extracted reasoning

The court exercised its discretion under Art. 66 LTF to waive judicial costs.
