Omnilex summary

The Federal Supreme Court declared the complaint inadmissible because it did not satisfy the statutory reasoning requirements. The appellant failed to address the decisive grounds of the cantonal judgment, which had relied on an interdisciplinary medical report and observations indicating full work capacity. In the simplified procedure, the court therefore did not enter into the complaint and waived court costs, rendering the request for free legal aid as exemption from costs moot.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b and Abs. 2 BGG; inadmissibility for insufficient reasoning: a federal complaint must, in concise form, explain which rights were violated and how. A merely appellatory submission that does not engage with the decisive reasons of the cantonal judgment does not satisfy this requirement and is not entered into in the simplified procedure (consid. 1). If no court costs are levied under Art. 66 Abs. 1 BGG, a request for exemption from costs becomes moot.

Urteil vom 15. Mai 2013
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter Meyer, als Einzelrichter,
Gerichtsschreiber Attinger.

Verfahrensbeteiligte
K.________,
Beschwerdeführer,

gegen

IV-Stelle des Kantons Zürich, Röntgenstrasse 17, 8005 Zürich,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

in Erwägung,

Key legal question

Whether the complaint met the minimum reasoning requirements of Art. 42 BGG.

Extracted holding

No. The filing did not engage with the decisive grounds of the lower court and therefore failed to state sufficiently why the contested decision violated the law.

Extracted reasoning

The complaint contained no substantive discussion of the lower court's key finding that the interdisciplinary expert report and surveillance indicated full work capacity.

Key legal question

Whether court costs should be charged and whether legal aid became moot.

Extracted holding

No court costs were charged, so the request for exemption from costs was moot.

Extracted reasoning

Under Art. 66(1) second sentence BGG, the court waived costs in the simplified procedure.
