Omnilex summary

The Federal Supreme Court did not enter into an appeal against a Federal Administrative Court non-entry decision in disability insurance matters because the appellant failed to challenge the lower court's non-entry reasoning and instead argued only the merits of the underlying dispute. Applying the simplified procedure, the Court held the appeal insufficiently reasoned under Art. 42 BGG and therefore inadmissible under Art. 108 Abs. 1 lit. b BGG. No court costs were imposed under Art. 66 Abs. 1 BGG.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b BGG; admissibility of an appeal against a non-entry decision requires a specific challenge to the non-entry reasoning. An appeal that addresses only the substantive merits of the underlying dispute, without showing why the lower court should have entered into the matter, lacks adequate reasoning and is therefore inadmissible. In such a case, the court may decide in simplified procedure and waive court costs under Art. 66 Abs. 1 second sentence BGG (consid. 1).

Gegenstand
Invalidenversicherung,

Beschwerde gegen den Entscheid
des Bundesverwaltungsgerichts
vom 22.

in Erwägung,

Key legal question

Whether the appeal against the non-entry decision met the reasoning requirements of Art. 42 BGG.

Extracted holding

No. The appeal failed to explain, even in summary form, why the Federal Administrative Court should have entered into the case.

Extracted reasoning

On non-entry decisions, an appeal that deals only with the merits without contesting the inadmissibility reasoning is not properly reasoned; here the appellant offered no argument on the non-entry issue.
