Omnilex summary

P. withdrew his appeal to the Federal Tribunal against the Geneva cantonal social-insurance judgment of 16 February 2009, adding a reservation for the remainder. The Federal Tribunal held that the reservation had no concrete legal significance and did not undermine the unconditional and explicit nature of the withdrawal. The case was therefore removed from the docket. Applying Art. 66 para. 2 LTF, the court decided not to charge judicial costs. The order was communicated to the parties, the cantonal court, and the Federal Social Insurance Office.

Omnilex headnote

Arts. 71 LTF and 73 al. 1 PCF; withdrawal of appeal and removal from the docket; Art. 66 al. 2 LTF, costs. A declaration of withdrawal of an appeal is effective if it is unconditional and explicit. A merely formulaic reservation such as "all rights reserved for the remainder" does not deprive the withdrawal of this character where it has no concrete legal scope. Upon valid withdrawal, the proceedings are struck from the role. Judicial costs may be waived under Art. 66 al. 2 LTF.

Ordonnance du 10 juin 2009
IIe Cour de droit social

Composition
MM. les Juges U. Meyer, Président,
Borella et Kernen.
Greffier: M. Berthoud.

Parties
P.________,
recourant,

contre

Office cantonal genevois de l'assurance-invalidité, rue de Lyon 97, 1203 Genève,
intimé.

Objet

que bien que la déclaration de retrait du recours soit accompagnée de la mention « tous droits réservés pour le surplus », on doit constater que cette réserve n'a aucune portée concrète et qu'elle n'affecte donc pas le caractère inconditionnel et explicite du retrait exigé par la jurisprudence (cf. ATF 119 V 36 consid. 1b p. 38, 111 V 156, 158);
que la cause doit dès lors être rayée du rôle en application des art. 71 LTF et 73 al. 1 PCF;

Extracted by Omnilex

Key legal question

Whether the appeal withdrawal was unconditional and effective despite the reservation wording.

Extracted holding

The reservation had no concrete effect and did not deprive the withdrawal of its unconditional and explicit character.

Extracted reasoning

A withdrawal must be unconditional and explicit under the case law; the added reservation 'all rights reserved for the remainder' did not alter the legal effect of the withdrawal.

Key legal question

Whether the proceedings should be removed from the docket and costs waived after withdrawal of the appeal.

Extracted holding

The case was struck from the docket and no judicial costs were charged.

Extracted reasoning

Because the appeal had been validly withdrawn, the case had to be removed from the docket under Arts. 71 LTF and 73 para. 1 PCF; costs were waived under Art. 66 para. 2 LTF.
