Omnilex summary

The appellant challenged a cantonal social insurance judgment in an invalidity insurance matter. The Federal Supreme Court found that the appeal did not satisfy the minimum requirements of Art. 42 BGG because it lacked a proper request and, above all, a reasoned discussion of the cantonal court's reasoning and the factual findings. The complaint was therefore not entered into in simplified procedure under Art. 108 BGG. The court waived court costs under Art. 66(1) second sentence BGG.

Omnilex headnote

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b und Abs. 2 BGG; Art. 97 Abs. 1 BGG; non-entry on an appeal that lacks sufficient requests and reasoning. An appeal must, in concise form, set out in what respect the challenged decision violates law; a mere disagreement with the outcome is insufficient. If the appellant fails to engage with the cantonal court's reasoning and does not specifically challenge the findings of fact as manifestly incorrect, the Federal Court may refuse to enter into the matter in simplified procedure. Where non-entry is ordered, court costs may exceptionally be waived under Art. 66 Abs. 1 sentence 2 BGG.

Urteil vom 30. Mai 2014

II. sozialrechtliche Abteilung

Besetzung
Bundesrichter Meyer, als Einzelrichter,
Gerichtsschreiber Schmutz.

Verfahrensbeteiligte
A.________,
Beschwerdeführer,

gegen

IV-Stelle des Kantons Zürich,
Röntgenstrasse 17, 8005 Zürich,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the appeal satisfied the formal requirements of Art. 42 BGG.

Extracted holding

No; the filing lacked an adequate request and sufficient reasoning engaging with the cantonal judgment.

Extracted reasoning

The appellant did not explain, in a concise manner, how the cantonal court violated the law. In particular, there was no substantive challenge to the lower court's reasoning or a substantiated attack on the findings of fact under Art. 97(1) BGG.

Key legal question

Whether the court should enter into the appeal in simplified procedure.

Extracted holding

No; the appeal was manifestly inadmissible and could be dismissed without full proceedings.

Extracted reasoning

Because the filing clearly failed to meet the statutory minimum requirements, non-entry in simplified procedure under Art. 108 BGG was warranted.

Key legal question

Court costs

Extracted holding

No court costs were charged.

Extracted reasoning

The court exercised the discretion provided by Art. 66(1) second sentence BGG to waive costs.
