Omnilex summary

The Federal Supreme Court, acting through its president in simplified procedure, held that the appeal against the Ticino insurance court judgment did not satisfy the mandatory reasoning requirements. The appellant failed to show, in a legally sufficient manner, that the lower court had made manifestly incorrect or unlawful factual findings; instead, the submission was largely appellatory and repetitive. The appeal was therefore declared inadmissible under Art. 108(1)(b) LTF. Given the circumstances, no court costs were imposed.

Omnilex headnote

Art. 42 cpv. 1-2 LTF, art. 97 cpv. 1 LTF, art. 108 cpv. 1 lett. b LTF; admissibility of the appeal and requirements of substantiated criticism of findings of fact. An appeal must set out the conclusions, reasons and evidence and, with sufficient precision, explain why the challenged decision violates federal law. A challenge to the facts is admissible only if the factual findings are manifestly inaccurate or otherwise unlawful and the correction is outcome-determinative. Purely appellatory criticism and repetitive argumentation do not satisfy these requirements and justify non-entry in simplified procedure (consid. 1). Under art. 66 cpv. 1 LTF, the Court may waive costs in the circumstances of the case.

Sentenza del 19 dicembre 2012
I Corte di diritto sociale

Composizione
Giudice federale Ursprung, Presidente,
cancelliere Schäuble.

Partecipanti al procedimento
L.________,
ricorrente,

contro

Sezione del lavoro del Cantone Ticino, Ufficio giuridico, Piazza Governo, 6501 Bellinzona,
opponente.

Oggetto

No. The appeal did not explain in a legally sufficient way why the lower court's factual findings were manifestly incorrect or unlawful; it was largely appellatory and repetitive.

Extracted reasoning

Key legal question

Whether court costs should be charged.

Extracted holding

No court costs were levied in view of the circumstances.

Extracted reasoning

The court exercised its discretion under Art. 66(1) LTF and waived costs.
