Omnilex summary

The appellant filed a federal appeal against a Bern cantonal social insurance judgment. The Federal Supreme Court held that the appeal did not satisfy the formal requirements of Art. 42 BGG because it contained neither a clear request nor a legally sufficient, decision-related reasoning. As the appeal period had already expired, the deficiency could no longer be cured. The Court therefore did not enter into the appeal and waived court costs.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; appeal must contain prayers for relief and reasons directed against the challenged decision; Art. 108 Abs. 1 lit. b BGG permits summary non-entry where these requirements are manifestly unmet. The reasoning must engage with the considerations of the attacked decision and, in concise form, show the infringement of federal law under Art. 95 BGG. A deficient appeal may be corrected only within the appeal period; once that period has expired, the defect is incurable. Under Art. 66 Abs. 1 second sentence BGG, the Court may waive costs in cases of non-entry.

Key legal question

Whether the appeal met the formal requirements of Art. 42 BGG, especially clear requests and a reasoned challenge to the cantonal judgment.

Extracted holding

The filing did not contain a clear request and did not engage with the reasoning of the challenged decision in a legally sufficient way.

Extracted reasoning

Under Arts. 42 and 95 BGG, an appeal must state requests and, in concise form, explain how the challenged decision violates federal law; this was not satisfied, and the defect could no longer be cured after expiry of the appeal period.
