Omnilex summary

The Federal Supreme Court dealt with an appeal in invalidity insurance against a cantonal decision confirming that the insured person had not made a sufficiently credible showing of a relevant deterioration in health and that the IV office therefore correctly refused to enter into the new application. The Court held that the appeal did not satisfy the minimum pleading requirements of Art. 42 BGG because it lacked a proper request and did not meaningfully engage with the decisive reasoning of the cantonal court. Without granting time to remedy the defect, the Court declared the appeal inadmissible in simplified procedure and imposed costs of CHF 300 on the appellant.

Omnilex headnote

Urteil vom 13. September 2010
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Batz.

Verfahrensbeteiligte
U.________,
Beschwerdeführer,

gegen

IV-Stelle des Kantons Zürich, Röntgenstrasse 17, 8005 Zürich,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung (Prozessvoraussetzung),

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the appeal met the formal reasoning requirements of Art. 42 BGG.

Extracted holding

The appeal did not contain a legally sufficient request and adequate reasoning because it failed to engage concretely and substantively with the decisive considerations of the cantonal judgment.

Extracted reasoning

Under Art. 42(1)-(2) BGG, an appeal must state the relief sought and explain in concise form how the contested decision violates the law; the appellant must address the lower court’s reasoning. These requirements were not met.

Key legal question

Whether the court should grant a grace period to cure the defects.

Extracted holding

No grace period was granted; the appeal was not cured and non-entry followed in summary procedure.

Extracted reasoning

For an insufficiently reasoned appeal, the court may decline to set a cure period and may decide under the simplified procedure of Art. 108(1)(b) BGG.

Key legal question

Allocation of court costs.

Extracted holding

Court costs were charged to the appellant.

Extracted reasoning

Costs follow the outcome of the proceedings under Art. 66(1) BGG.
