Omnilex summary

The Federal Court held that the appellant's submission against the Zurich Social Insurance Court did not satisfy the minimum requirements for a federal appeal under Art. 42 BGG. It contained neither an adequate request nor a substantiated challenge to the cantonal court's reasoning or findings. After the court expressly pointed out the defect and the possible correction within the appeal deadline, the appellant did not respond. The court therefore refused to enter into the appeal in simplified proceedings and waived court costs.

Omnilex headnote

Art. 42 Abs. 1 und 2 BGG, Art. 108 Abs. 1 lit. b BGG; requirements for admissibility of an appeal. A federal appeal must contain specific requests and a reasoned submission showing, in a concise manner, how the challenged decision violates law; the appellant must engage with the decisive reasoning of the lower court. A mere general disagreement or an unsupported attack on the facts does not suffice, especially where factual findings are challenged under Art. 97 Abs. 1 BGG without substantiation. If the defect is not cured within the appeal period despite an express warning, the appeal is not entered into in simplified proceedings. Court costs may be waived under Art. 66 Abs. 1 Satz 2 BGG.

Urteil vom 25. Oktober 2011
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Batz.

Verfahrensbeteiligte
T.________,
Beschwerdeführer,

gegen

Arbeitslosenkasse syndicom,
Stauffacherstrasse 60, 8004 Zürich,
Beschwerdegegnerin.

Gegenstand
Arbeitslosenversicherung (Prozessvoraussetzung),

Beschwerde gegen den Entscheid des Sozialversicherungsgerichts des Kantons Zürich
vom 17. Juni 2011.

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the appeal met the formal requirements of Art. 42 BGG and could be considered.

Extracted holding

The filing did not contain a sufficient request or a legally adequate reasoning engaging with the cantonal court's findings, so it was not a valid appeal.

Extracted reasoning

Art. 42 BGG requires requests and a reasoned explanation; the appellant failed to show, even in outline, how the lower court's findings were erroneous under Art. 97 BGG. He did not respond to the Federal Court's notice and correction opportunity.

Key legal question

Whether court costs should be charged despite the non-entry decision.

Extracted holding

No court costs were imposed.

Extracted reasoning

Under Art. 66 Abs. 1 Satz 2 BGG, the court waived costs in this procedural dismissal.
