Omnilex summary

The Federal Supreme Court was seised of an appeal in an accident insurance dispute against a cantonal judgment of the Bern Administrative Court. The appeal was found not to meet the minimum formal requirements because it lacked a proper request and sufficient reasoning showing why the cantonal decision was unlawful. The court therefore did not enter into the matter under simplified procedure and waived court costs.

Omnilex headnote

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b BGG; formal requirements for a federal appeal and non-entry in simplified procedure. An appeal must contain a specific request and a reasoned submission setting out, in concise form, how the challenged decision infringes the law; mere dissatisfaction or unsubstantiated criticism of the facts is insufficient. If these minimum requirements are not met, the Federal Supreme Court may decline to enter into the appeal without examining other admissibility questions, including timeliness. Under Art. 66 Abs. 1 sentence 2 BGG, court costs may be waived in such a non-entry decision.

Besetzung

Beschwerdeführer,

gegen

Schweizerische Unfallversicherungsanstalt (SUVA), Fluhmattstrasse 1, 6004 Luzern,
Beschwerdegegnerin.

Gegenstand
Unfallversicherung,

Mai 2008.

Nach Einsicht
in die Beschwerde vom 19. Juni (Datum auf der Eingabe) bzw. 26. Juni 2008 (Poststempel) gegen den Entscheid des Verwaltungsgerichts des Kantons Bern, Sozialversicherungsrechtliche Abteilung, vom 13. Mai 2008,
in Erwägung,

Extracted by Omnilex

Key legal question

Whether the appeal met the formal requirements of Art. 42 BGG.

Extracted holding

No. The filing did not contain a legally sufficient request and did not show, in a concise manner, how the challenged decision violated law.

Extracted reasoning

The submission failed to satisfy the minimum content requirements for a federal appeal, so the court could not review alleged errors in the facts or reasoning.

Key legal question

Whether the Federal Supreme Court should enter into the appeal despite the possible timeliness issue.

Extracted holding

No. Because the appeal was inadmissible for lack of sufficient reasoning, the court did not need to decide whether it had been filed within the appeal period.

Extracted reasoning

The deficiency under Art. 42 BGG alone justified non-entry in simplified proceedings.

Key legal question

Whether court costs should be charged.

Extracted holding

No court costs were imposed.

Extracted reasoning

Applying Art. 66(1) second sentence BGG, the court waived costs.
