Non-entry for insufficiently reasoned social insurance appeal

Omnilex summary

The Federal Supreme Court held that the appellant's submission failed to meet the minimum reasoning requirements for a federal appeal. He did not address the cantonal court's reasons for upholding the labor insurance fund's non-entry decision, but instead discussed why he had not declared extra earnings. The Court therefore did not enter into the appeal in simplified proceedings and waived court costs.

Omnilex headnote

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG: an appeal must contain prayers for relief and, in concise form, reasons showing in what respect the challenged decision violates law. If the appellant does not engage with the reasoning of the cantonal decision and merely restates factual explanations without demonstrating legal error, the submission is manifestly insufficiently reasoned and non-entry is warranted in summary procedure. Where non-entry is pronounced under Art. 108 Abs. 1 lit. b BGG, court costs may be waived under Art. 66 Abs. 1 sentence 2 BGG (consid. 1).

Urteil vom 19. Juni 2009
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Grünvogel.

Parteien
N.________,
Beschwerdeführer,

gegen

Arbeitslosenkasse des Kantons Zürich,
Brunngasse 6, 8405 Winterthur,
Beschwerdegegnerin.

Gegenstand
Arbeitslosenversicherung,

in Erwägung,

Key legal question

Whether the federal appeal met the reasoning requirements of Art. 42 BGG and could be entered into.

Extracted holding

The appeal did not satisfy the statutory reasoning requirements because it failed to engage with the cantonal court's reasoning and did not show any legal error.

Extracted reasoning

The appellant merely explained why he had not declared additional earnings, instead of showing why the lower court's findings or legal conclusions were wrong. The submission therefore did not sufficiently challenge the contested decision under Art. 42 BGG.

Key legal question

Whether court costs should be charged despite non-entry.

Extracted holding

No court costs were imposed.

Extracted reasoning

In summary proceedings, the court waived costs under the applicable cost rule.
