Omnilex summary

P. appealed against a Zurich social insurance court order concerning invalidity insurance. The Federal Court had already warned him about the formal requirements for an appeal and the possibility of curing defects within the time limit. His filings of 1 and 22 June 2012 still lacked an admissible request and a reasoned challenge to the lower court's findings. The Court therefore treated the appeal as inadmissible under the simplified procedure, did not enter into the matter, and exceptionally waived court costs.

Omnilex headnote

Art. 42 Abs. 1 und 2 BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b BGG; insufficiently reasoned appeal and non-entry: a remedy must contain clear requests and an argumentation that engages with the reasons of the challenged decision and identifies the alleged legal error. A mere submission lacking a substantive critique of the lower court's factual and legal reasoning does not satisfy the minimum requirements for valid appellate pleading. If, after express warning and opportunity to cure within the appeal period, the defects remain uncured, the Federal Court may decide in simplified procedure and refuse to enter into the appeal (consid. 1). Costs may exceptionally be waived under Art. 66 Abs. 1 sentence 2 BGG where the circumstances so justify (consid. 2).

Urteil vom 9. Juli 2012
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiberin Kopp Käch.

Verfahrensbeteiligte
P.________,
Beschwerdeführer,

gegen

IV-Stelle des Kantons Zürich, Röntgenstrasse 17, 8005 Zürich,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung (Prozessvoraussetzung),

Juni 2012 eingereichte Eingabe,

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the appeal met the formal requirements of Art. 42 BGG.

Extracted holding

The submissions did not contain an admissible request or adequate reasoning and failed to address the challenged decision's reasoning.

Extracted reasoning

An appeal must state requests and reasons showing in concise form how the decision violates law; the appellant must engage with the lower court's reasoning. The filed submissions did not do so.

Key legal question

Whether the appeal could be entered despite the defective filing after a warning and opportunity to cure.

Extracted holding

No valid remedy was filed, so the appeal was inadmissible and could not be entered into under Art. 108 Abs. 1 lit. b BGG.

Extracted reasoning

Even after express notice of the formal requirements and the limited opportunity to remedy defects within the appeal period, the subsequent submission remained deficient.

Key legal question

Whether court costs should be charged.

Extracted holding

Court costs were exceptionally waived.

Extracted reasoning

Given the circumstances, the Court departed from the usual rule and refrained from charging costs under Art. 66 Abs. 1 sentence 2 BGG.
