Omnilex summary

The appellant challenged an unspecified cantonal insurance-court decision in invalidity insurance before the Federal Supreme Court. The court had previously pointed out formal defects, in particular missing annexes, and granted a grace period. Because the appellant did not cure the defect within the deadline, and the later submission still failed to satisfy the formal pleading requirements, the court issued a simplified non-entry decision under Article 108 BGG. The appellant was ordered to pay reduced court costs of CHF 300, taking account of his financial situation.

Omnilex headnote

Art. 42 Abs. 1 und 2 BGG, Art. 42 Abs. 5 BGG, Art. 108 BGG; form defects in a complaint and non-entry in simplified proceedings: If the Federal Supreme Court sets a grace period to remedy a formal defect, in particular missing annexes, and the defect is not cured within the prescribed deadline, the Court shall not enter into the matter under Art. 108 BGG. A subsequent submission does not render the remedy admissible unless it fully cures the notified defect and complies with the formal requirements of Art. 42 Abs. 1 and 2 BGG. Court costs are borne by the losing party and may be reduced in consideration of financial hardship (Art. 66 Abs. 1 BGG).

Urteil vom 18. Juli 2008
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Batz.

Parteien
H.________,
Beschwerdeführer,

gegen

Unbekannten Beschwerdegegner.

Gegenstand
Invalidenversicherung,

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the complaint should be entered into despite unresolved formal defects and missing annexes.

Extracted holding

The court refused to enter into the filing because the appellant did not remedy the notified formal defect within the deadline and the submissions still did not satisfy the formal requirements.

Extracted reasoning

After the court had set a grace period under the Federal Supreme Court Act, the missing annexes were still not provided; the later filing did not cure the defect and the submissions also failed to meet the formal pleading requirements.

Key legal question

Who bears the court costs after non-entry.

Extracted holding

The appellant was ordered to pay the federal court costs, reduced in light of his apparently difficult financial situation.

Extracted reasoning

Costs follow the procedural outcome, with consideration given to the appellant's financial circumstances when fixing the amount.
