Omnilex summary

The appellant challenged a St. Gallen insurance court decision concerning supplementary benefits to AHV/IV. The Federal Supreme Court held that the appeal of 8 June 2007 did not satisfy the reasoning requirements of Art. 42 BGG. The later submission of 21 June 2007 did not cure the defect because it was still insufficiently reasoned and, in any event, was filed after the appeal deadline. The Court therefore did not enter into the matter and imposed court costs of CHF 250 on the appellant, offsetting them against the advance payment and ordering a refund of the balance.

Omnilex headnote

Art. 42 BGG, Art. 100(1) BGG; admissibility of appeals and cure of defects in reasoning: the appeal must state requests and reasons in concise form and explain how the challenged decision infringes law. A merely substantively insufficient appeal does not fall within the curable defects contemplated by Art. 42(5) or (6) BGG; the Federal Supreme Court may not grant an additional remedy period for such deficiency. A later submission filed after expiry of the appeal period cannot remedy the inadmissibility. In summary proceedings under Art. 108(1)(b) BGG, the Court may decline to enter into the matter and allocate costs under Art. 66(1) BGG.

Urteil vom 3. August 2007
I. sozialrechtliche Abteilung

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Batz.

Parteien
K.________, Beschwerdeführer,

gegen

Sozialversicherungsanstalt des Kantons St. Gallen, Brauerstrasse 54, 9016 St. Gallen, Beschwerdegegnerin.

Gegenstand

Mai 2007.

Das Präsidium der I. sozialrechtlichen Abteilung hat nach Einsicht
in die Eingabe des K.________ vom 8. Juni 2007 (Poststempel) gegen einen Entscheid des Versicherungsgerichts des Kantons St. Gallen vom 8. Mai 2007 (EL 2006/48),
in Erwägung,

3.
Dieses Urteil wird den Parteien, dem Versicherungsgericht des Kantons St. Gallen, der CSS Versicherung, St. Gallen, und dem Bundesamt für Sozialversicherungen zugestellt.

Extracted by Omnilex

Key legal question

Whether the appeal met the formal reasoning requirements under Art. 42 BGG.

Extracted holding

No. The submissions did not sufficiently explain in a concise form how the challenged decision violated the law.

Extracted reasoning

An appeal must contain requests and reasons with evidence references; the appellant's filing, and the later supplement, failed to satisfy these requirements.

Key legal question

Whether the defect could be cured by setting a time limit or by the later filing.

Extracted holding

No. The deficiency was substantive, not one of the curable cases under Art. 42(5) or (6) BGG, and the later filing was also out of time.

Extracted reasoning

Only the situations listed in Art. 42(5) or (6) BGG allow a deadline to remedy defects; the later submission was filed after the appeal period expired.

Key legal question

Allocation of court costs.

Extracted holding

Court costs of CHF 250 were charged to the appellant, offset against the advance payment, with CHF 250 to be refunded.

Extracted reasoning

Costs were imposed under the Federal Supreme Court Act.
