Omnilex summary

H.________ appealed a cantonal insurance court decision to the Federal Supreme Court. The Court found that the appeal had been filed only on 17 December 2010, although the 30-day time limit had expired on 29 October 2010 after service of the cantonal judgment on 29 September 2010. In simplified proceedings, the Court therefore declined to enter into the appeal. It also waived court costs.

Omnilex headnote

Art. 100 Abs. 1 BGG, Art. 108 Abs. 1 lit. a BGG; timeliness of the appeal and non-entry: the appeal period is mandatory and, once expired, precludes substantive review. If the appeal is manifestly late, the Federal Supreme Court decides by simplified procedure and declares non-entry. Under Art. 66 Abs. 1 sentence 2 BGG, the Court may waive court costs.
