Omnilex summary

The Federal Supreme Court held that the appeal against a Federal Administrative Court decision in an invalidity insurance matter was filed out of time. Because the decision had been served by publication on 20 October 2009 and the 30-day deadline expired on 19 November 2009, the appeal lodged on 29 December 2009 was inadmissible. The case was dealt with in simplified procedure. The Court waived court costs.

Omnilex headnote

Art. 100 Abs. 1 BGG in conjunction with Art. 44-48 BGG; Art. 108 Abs. 1 lit. a BGG: an appeal filed after expiry of the statutory time limit is not entered into. Where a decision is served by publication, the ordinary appeal period begins with such service and is calculated according to the general time-limit rules. If the lateness is evident, the court may decide in simplified procedure without entering into the merits. Under Art. 66 Abs. 1 Satz 2 BGG, court costs may be waived in such a non-entry decision.
