Omnilex summary

The Federal Supreme Court refused to enter into the applicant's request for revision of judgment 6B_456/2009. It held that revision grounds are exhaustively listed in Arts. 121-123 BGG and that the applicant merely criticized the costs fixed in the earlier judgment, which is not a valid revision ground. The court exceptionally waived court costs, making the request for free legal aid moot.

Omnilex headnote

Arts. 121-123 BGG; revision of a Federal Supreme Court judgment is admissible only on the exhaustively enumerated statutory grounds. A submission that merely contests the amount of court costs imposed in the challenged judgment does not invoke a revision ground and is therefore inadmissible. Where the court exceptionally refrains from levying costs, a pending request for free legal aid becomes moot (consid. 1-2).

Gerichtsschreiber Monn.

gegen

Staatsanwaltschaft des Kantons Wallis, 1950 Sitten 2,

Gegenstand
Revision eines bundesgerichtlichen Urteils (6B_456/2009).

Das Bundesgericht zieht in Erwägung:

1.

1.
Auf das Revisionsgesuch wird nicht eingetreten.

2.
Es werden keine Gerichtskosten erhoben.

3.
Dieses Urteil wird den Parteien und dem Kantonsgericht des Kantons Wallis, I. Strafrechtliche Abteilung, schriftlich mitgeteilt.

Key legal question

Whether the revision request was admissible under Arts. 121-123 BGG.

Extracted holding

The request was inadmissible because it alleged only criticism of the costs fixed in the earlier judgment, not a statutory ground for revision.

Extracted reasoning

Revision grounds are exhaustively listed in Arts. 121, 122 and 123 BGG. A mere challenge to the amount of court costs is not a permissible revision ground.

Key legal question

Whether court costs should be imposed in the revision proceedings.

Extracted holding

No court costs were levied exceptionally.

Extracted reasoning

The court decided to waive costs exceptionally, which also rendered the legal-aid request moot.
