Omnilex summary

The Federal Supreme Court considered a revision request against its earlier judgment 6B_106/2009, in which it had not entered into the applicant’s appeal because the advance on costs had not been paid. The applicant did not rely on any statutory revision ground under the Federal Supreme Court Act, but argued only the merits of the underlying case. The Court therefore held the revision request inadmissible. It further refused free legal aid because the request was hopeless, and imposed court costs of CHF 500 on the applicant.

Omnilex headnote

Arts. 121-123 BGG; revision of a Federal Supreme Court judgment is limited to the exhaustively enumerated statutory grounds. A filing that merely attacks the merits of the prior decision, without invoking a revision ground, is inadmissible. Art. 64 Abs. 1 BGG: legal aid is to be refused where the requested relief is manifestly without prospects of success. Art. 66 Abs. 1 BGG: costs are borne by the unsuccessful party.

Urteil vom 6. Juli 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Bundesrichter Schneider, Mathys,
Gerichtsschreiberin Arquint Hill.

Parteien
X.________,
Gesuchsteller,

gegen

Staatsanwaltschaft des Kantons Graubünden, 7001 Chur,
Gesuchsgegnerin.

Gegenstand
Revision des Urteils des Bundesgerichts vom 16. April 2009 (6B_106/2009).

Das Bundesgericht zieht in Erwägung:

1.
