Omnilex summary

The Federal Supreme Court rejected as inadmissible X.’s request to revisit its prior criminal inadmissibility ruling. It held that she did not identify any statutory ground for revision and merely sought a fresh review on the merits, which is insufficient under the LTF. Because the request had no prospect of success, legal aid was denied. Court costs of CHF 800 were imposed on X., taking account of her financial situation.

Omnilex headnote

Arts. 121 ff. and 42 LTF; revision of a Federal Supreme Court judgment is admissible only if a statutory ground for revision is specifically and substantiatedly invoked. A request that merely seeks a renewed examination on the merits, without identifying a cognizable revision ground, is inadmissible. If the pleading is manifestly without prospects of success, legal aid must be refused under Art. 64(1) LTF; costs are charged to the unsuccessful party under Art. 66(1) LTF, with moderation according to financial circumstances.

Objet

Key legal question

Whether the request for revision of the Federal Supreme Court judgment 6B_378/2012 was admissible.

Extracted holding

The request was inadmissible because the applicant failed to show any ground for revision under Arts. 121 ff. LTF and did not satisfy the substantiation requirements of Art. 42 LTF.

Extracted reasoning

A revision request may only succeed if a statutory revision ground is specifically demonstrated. The applicant merely sought a new review on the merits and did not attack the prior inadmissibility ruling with a cognizable revision argument.

Key legal question

Whether legal aid should be granted.

Extracted holding

Legal aid was refused because the request had no prospect of success.

Extracted reasoning

Under Art. 64(1) LTF, assistance is denied where the pleading is manifestly hopeless.

Key legal question

Who bears the court costs.

Extracted holding

The applicant must bear the judicial costs, reduced in view of her financial situation.

Extracted reasoning

Because she failed, costs were imposed on her under Art. 66(1) LTF, with the amount set at CHF 800 taking account of her means.
